IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD CIVIL APPLICATION NO. 8661 OF 2012 IN CIVIL REVISION APPLICATION NO. 629 OF 2001 Shri Vinod Zumberlal Rathi Applicant
Versus
Shri Pandharinath Rajaram Kadam Respondent Mr. Vivek Bhavthankar, advocate for applicant. CORAM : M.S. SONAK, J.
DATE : 16th JANUARY, 2018 PER COURT:
1.
Learned counsel for applicant states that he has addressed a letter to the applicant seeking instructions as to whether the applicant is interested in pursuing this matter. Learned counsel states that he has received no instructions from the applicant. 2.
In this matter, civil revision application no. 629/2001 came to be disposed of on 06.05.2009. The application for restoration was taken out in the year 2012 i.e. after delay of about 3 years and 30 days. The matter is being coming up on the board from time to time merely because no spare copy of the civil application has been furnished so as to effect service upon respondents. 3.
Learned counsel for applicant requests that the letter addressed by him to the applicant be taken on record. There is no necessity to take such letter on record. However, statement of learned counsel is noted.
{2} ca8661.12.odt 4.
Taking into consideration the aforesaid circumstances, and also the fact that there is hardly any cause shown to explain delay of about 30 days, this civil application is dismissed. ( M.S. SONAK, J. ) dyb
