1) The application is filed by wife for transfer of Civil Misc. Application No.55/2014 pending in the Family Court Mumbai, Bandra to the District Court at Bhusawal. Notice of the present proceeding was duly served on the husband, but he has not turned up.

2) It is the case of the wife that she is housewife, she is resident of Bhusawal, situated at the distance of more than 400 kilometers from Mumbai. It is her case that every occasion she will be required to take one attendant to go to Family Court Mumbai and she cannot afford to spend on attendant and conveyance. It is her case that

2 MCA 134/2016 she has filed one proceeding for maintenance in Bhusawal against the respondent, husband and in any case the husband is required to come to Bhusawal to contest that proceeding. No inconvenience will be caused to him of both the matters are brought at one and the same station. 3) In view of these unrebutted contentions made and the submissions made, this Court holds that the application needs to be allowed. The application is allowed. Civil Misc. Application No.55/2014 presently pending in the Family Court Mumbai, Bandra is hereby withdrawn from that Court and is transferred to the Court of District Judge Bhusawal. The new Court to take care and see that the date of the present matter matches with the date of proceeding, if any, filed by the wife at Bhusawal. The new Court to issue notice on Court motion to the husband before starting of hearing of the present proceeding as he has not turned up in the present matter. The parties to appear in the new Court on 30th September 2016.
