This Court, while issuing notice on 15.07.2025, referred to the Full Bench judgment in the case of Kalpana Nilkanth Patil V/s. State of Maharashtra & Ors. We found, prima facie, that the case of the Petitioner is covered by the law laid down in the said Full Bench judgment. 2.

In the said judgment, this Court held that the name of a family member can be substituted in place of the Original Applicant for appointment on compassionate grounds. It was also held that even if the Original Applicant, whose name may be in the waiting list, has crossed the age limit of 45 years, the substitution should be permitted.

The learned counsel appearing for Respondent Nos.2 and 3 i.e. the Municipal Corporation fairly states that in line with the law laid down by this Court in the aforesaid Full Bench judgment, a proposal for substituting the name of the Petitioner in place of her mother has been moved and therefore, the grievance in this petition no longer survives. 4.

The learned counsel for the Petitioner submits that this Court may clarify that the name of the Petitioner may be substituted in the waiting list where the name of her mother was originally recorded. We are assured that appropriate steps would be taken in that regard in the light of the law laid down by this Court 5.

Since the grievance of the Petitioner stands satisfied, nothing survives in the present petition and it is disposed of as such. Pending applications, if any, also stand disposed of. [Y.G. KHOBRAGADE, J.] [MANISH PITALE, J.] mub
