O R D E R

The proceeding is placed before us in today's National LokAdalat. This appeal is preferred by the appellant feeling aggrieved by the impugned judgment and award passed by the MACT, Osmanabad. Mr. Dahat, learned counsel for the appellant has placed on record pursis.

The appellant intends to withdraw the appeal. The puriss and authority letter are taken on record and marked as Art. 'X' and 'Y' respectively for identification.

The learned Counsel appearing for appellant/Insurance Company made a statement that amount of compensation as per the Award Passed in MACP No. 135/2008 has been deposited in this Court. 4.

The compensation amount deposited by the appellant/Insurance Company be transferred to the MACT, Osmanabad.

The Chairman/Member, MACT, Osmanabad shall pass an appropriate order regarding disbursement of amount of compensation to the original claimants.

If substantive appeal is filed by the original claimants subsequently, then in that case, the appellant/Insurance Company is entitled to restore its appeal.

7.

The Chairman/Member, Motor Accident Claim Tribunal, Osmanabad be informed accordingly.

8.

The court fee refund certificate be issued as per the rules. 9.
