I have heard learned Counsel for the applicant for some time.
It appears that apart from the direct evidence, the blood stained clothes and weapon axe came to be seized during the course of investigation. It also appears that mother and wife of the deceased have not actually seen the assault and weapon used. The learned Counsel for the applicant has repeatedly made the submission that deceased Laxman sustained injuries during the course of quarrel by falling down from the terrace.

The learned Counsel for the applicant, thus, on instructions seeks leave to withdraw this application with liberty to the applicant to fle an application for regular bail before the Sessions Court after receipt of the C.A. reports pertaining to blood stained clothes and the weapon axe.
Leave granted. Application is disposed of as withdrawn with the liberty, as prayed for.
