The State Of Maharashtra And Others .....Respondents .....
Mr. S.N. Rodge h/f Mr. A.R. Shinde, Advocate for the Petitioner Mr. A.V. Lavte, AGP for State .......
CORAM : NITIN B. SURYAWANSHI AND VAISHALI PATIL JADHAV, JJ.
DATE : 10th DECEMBER, 2025 ORDER :
1.
Respondent No. 3 has filed affidavit in reply contending that a demand for payment of rental compensation of Rs. 66,871/- to the petitioner is raised with the Collector on 03.12.2025 and the deponent has substantially complied with the order passed by this Court.
2.
It is necessary to note here that by order dated 07.01.2015 we directed respondent No. 2 in the writ petition i.e. Sub Divisional Officer/Special Land Acquisition Officer to determine the rental compensation. The Executive Engineer/respondent No. 3 was directed to disburse the amount of rental compensation determined by Bhagyawant Punde
{2} 909-CP-200-2017 respondent No. 2 within three months from the date of determination. From Exhibit-R-2, Page No. 32 it appears that respondent No. 3 has determined the rental compensation of petitioner on 06.10.2025 and on 03.12.2025, proposal is forwarded to the Collector for payment of rental compensation. It is therefore clear that from the date of order till the year 2025, respondents have failed to take any action as per the directions of this Court.
3.
In this view of the matter, respondents are directed to pay rental compensation to the petitioner within four weeks from today along with 8% simple interest per annum. Said interest can be recovered from the concerned Officer who has committed lapses in complying with directions of this Court.
4.
With these directions, contempt petition is disposed of. 5.
It is made clear that, if the time stipulation is not followed, same will be treated as aggravated form of contempt. (VAISHALI PATIL JADHAV, J.) (NITIN B. SURYAWANSHI, J.) Bhagyawant Punde
