The applicant is seeking bail in connection with crime No. 167 of 2020 registered with Kurunda police station, District Hingoli for the offences punishable under Sections 353, 332, 379, 279, 143, 147, 504, 506, 188 of I.P.C. and under section 48(7), 48(8) of the Maharashtra Land Revenue Code. His criminal bail application bearing No. 218 of 2020 with similar prayer came to be rejected by the learned Additional Sessions Judge, Basmathnagar vide order dated 5.10.2020.

This pertains to transportation of sand illegally in the trolley attached to the tractor. Though the name of the applicant is mentioned in the F.I.R. with specific role ascribed to him, however, the applicant is in jail in connection with the present crime since long. The investigation is now over and the charge sheet has been

ba1209.20 -2submitted. There is only one case registered against the applicant on previous occasion in the year 2019. On perusal of charge sheet, it appears that the informant has only sustained simple injury. On the same set of allegations, other co-accused persons came to be released on bail by the court below. Thus, considering the entire aspects of the case, I am inclined to release the applicant on bail with certain conditions. Hence the following order:-

O R D E R

I.

Application is hereby allowed.

II.

The applicant Pralhad s/o Uttamrao Aher, in connection with crime No. 167 of 2020 registered with Kurunda police station, District Hingoli for the offences punishable under Sections 353, 332, 379, 279, 143, 147, 504, 506, 188 of I.P.C. and under section 48(7), 48(8) of the Maharashtra Land Revenue Code be released on bail on furnishing personal bond of Rs.15,000/- with one surety of the like amount on following conditions:- a) The applicant shall not tamper with the prosecution evidence in any manner.

b) The applicant shall not indulge in similar activities in future till the conclusion of trial.
