The applicant seeks withdrawal of the amount deposited by the respondent -acquiring body in pursuance of the award dated 12.2.2018 passed in LAR No.246 of 2004.

Application is vehemently opposed on behalf of the respondent no.2.

Having considered the submissions advanced, it is apparent that, land of the applicant has been acquired. Reference Court has determined compensation on the basis of evidence lead by the parties. Consequently, it would be appropriate to permit the applicant to withdraw 50% of the amount deposited by the acquiring body subject to furnishing of usual undertaking to the satisfaction of the Registrar (Judicial) of this Court. Civil application stands disposed off.
