The learned counsel for the applicants submits that considering the affidavit filed by the respondents, the applicants are assailing the order passed by the Collector. The learned counsel submits that the facts and circumstances necessitate the amendment.

Mr. Naiknaware, learned counsel opposes the application and submits that the applicants have alternate remedy to challenge the order of the Additional Collector.

All these aspects will be gone into while hearing the writ petition for admission. The

(2) 1-ca-6798-2020 petition is not yet admitted. The non-applicants will have every right to controvert the averments sought to be introduced by way of an amendment. 4.

Keeping defences of respondents open, civil application for amendment is allowed.

Civil Application is disposed of.
