IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 88 WRIT PETITION NO.550 OF 2023 ASHISH RAGHUVIR AGNIHOTRI

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...

Advocate for Petitioner : Mr. R.C. Brahmankar h/f. Panpatte V.S. AGP for Respondents/State : Mr. V.M. Kagne ...

CORAM : RAVINDRA V. GHUGE & Y.G. KHOBRAGADE, JJ.

DATE : 28th July, 2023 P.C. :- 1.

This matter was called out at 06.30 p.m.

2.

The contention of the Petitioner is that he is working as a ' Shipai / Sewak' from 01.08.2013 till 31.07.2016 and even today he is in employment. The proposal for approval dated 23.10.2013, tendered by the Management, is pending. The only request put-forth by the Petitioner is that the same may be decided on it's own merits.

3.

The learned AGP submits that, if this Court directs a decision to be arrived at within a time frame, the Education Officer shall first find out whether such a proposal is filed and if it is filed, he would decide the same within the timeline as directed by this Court, provided it is not yet decided.

( 2 ) 88 wp 550.23 4.

We record the above contention of the learned AGP. By keeping the said options open and if the proposal is still pending, the same may be decided on perusing the records available, with due circumspection, considering the law and the policy applicable, within 60 days from today. 5.

With the above directions, this petition is disposed off. [Y.G. KHOBRAGADE, J.] [RAVINDRA V. GHUGE, J.] mub
