The execution proceedings are still pending. The suit for partition and separate possession filed by the petitioner, according to the learned counsel for the petitioner is decreed. The said decree is confirmed in First Appeal. The respondent filed Second Appeal. The same is pending before this Court. The parties have arrived at the compromise.

Now the learned counsel for the petitioner submits that the land of the petitioner is not being measured. 3.

We are not aware of the status of the execution proceedings nor the position in the Second Appeal.

The petitioner may take steps as may be permissible in law in the pending proceedings.

With regard to the prayer for mutation entry, the petitioner has remedy under the Maharashtra Land Revenue Act. 6.
