The learned counsel for the Applicant fairly submits that during the pendency of this application, the investigation is completed and the charge sheet is filed. He upon instructions seeks leave to withdraw this application with liberty to file a fresh application before the Sessions Court.

Hence, in view of change in circumstance, the Applicant would approach the learned Sessions Court under Section 439 of the Code of Criminal Procedure. The learned Sessions Court shall not be influenced by the withdrawal of this application and shall consider the application on it's own merits.
