Applicants are seeking withdrawal of amount of Rs.26,15,519/- + Rs.25000/- = Rs. 26,40,519/- deposited by the Respondent/MSRTC in this Court. It is informed that Respondent Nos. 3 and 4 who are parents of the deceased, have already been disbursed 60% amount falling to their shares as per the apportionment made in operative part no.2 of the impugned judgment and award. The balance amount is still lying in this Court. 3.

Considering the rival submissions of the parties and the apportionment made by the Tribunal, I find it fit to permit the Applicant No.1 to receive Rs.10 Lacs and the Applicant No.2 to receive Rs. 4 Lacs.

Civil Application is partly allowed.

Applicant No.1 shall be disbursed Rs.10 Lacs and Applicant No.2 shall be disbursed Rs.4 Lacs from the balance amount on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court.

Needless to mention that Applicant No.1 shall be entitled to receive amount on behalf of Applicant No.2.
