The learned Advocate for the Petitioner submits that the Deputy Commissioner (Establishment) from the office of the Divisional Commissioner, Chhatrapati Sambhajinagar, has turned down the claim of the Petitioner for reimbursement of the medical bills, vide the order/communication dated 13/09/2023, addressed to the Chief Executive Officer, Zilla Parishad, Nanded. He submits that the office of the Divisional Commissioner should have forwarded the proposal with remarks to the Competent

7415.24wp (2) Committee constituted under the Government Resolution dated 19/03/2005 for this specific purpose.

The learned A.G.P. submits that the proposal should have been forwarded with the remarks of the office to the said Committee.

In view of the above, this Writ Petition is disposed off with the following directions :- (a) The impugned order dated 13/09/2023 is rendered inconsequential.

(b) The Chief Executive Officer will re-forward the proposal to the Divisional Commissioner, which office shall transmit it within 30 days, to the Competent Committee and Committee shall decide the same within 90 days. (Y. G. KHOBRAGADE, J.) (RAVINDRA V. GHUGE, J.) sjk
