IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO. 2818 OF 2019 IN/WITH R.C. NO. 1315 OF 2017 IN/WITH WRIT PETITION STAMP NO. 20054 OF 2017 Trambak Nivrutti Parad ..APPLICANT

VERSUS

State of Maharashtra & Ors.

..RESPONDENTS Mr P. S. Pawar, Advocate for applicant;

Ms R. P. Gour, A.G.P. for respondent No. 1 & 2. CORAM : PRASANNA B. VARALE AND S. M. GAVHANE, JJ.

DATE : 15th February, 2019 ORAL ORDER:

Heard the learned Counsel for the applicant.

2.

Learned Counsel for the applicant submits that due to non-removal of office objections, registration was refused. Learned Counsel further submits that there was some communication gap and as such within stipulated period, office objections could not be removed. 3.

On perusal of the petition, we found that the petition was filed with solitary prayer of directions to decide the proposal for approval of

CA2818.19 (2) appointment of the petitioner as a peon in respondent No. 4 - School. On further query made to learned Counsel, the Counsel submitted that as per his instructions now the proposal is already decided and it is rejected. 4.

Considering these facts, the application is allowed. 5.

The petition is restored to its file and in view of the fact that the order is passed by the authority rejecting proposal of the petitioner, the efficacy of the petition seeking directions to decide the proposal has lost. If the petitioner is aggrieved by the order of rejections, he is at liberty to take appropriate steps and avail remedies including approaching the competent forum.

6.

In view of these facts, the petition is also disposed of with aforesaid liberty.
