The petitioner claims to belongs to Mannervarlu Scheduled Tribe and has been appointed as Vidyut Sahayyak by respondent No.2 as against the vacancy reserved for Scheduled Tribe category. On account of failure of the petitioner to submit validity certificate, the employer has issued show cause notice to the petitioner on 21.06.2016 asking him to submit validity certificate within seven days and it has been further informed that in the event of failure, his appointment would be cancelled.

In the facts and circumstance of the case, this petition can be disposed of by issuing directions to the respondent No. 1 Committee to take decision on the tribe certificate validation proposal of the 1/2

932.odt petitioner submitted to the Committee as expeditiously as possible, preferably within a period of six months from today and it is accordingly directed.

The counsel appearing for respondent No.2-MSEDCL states that appointment of the petitioner on the post of 'Technician' would be regularized provisionally subject to outcome of the decision on the tribe certificate validation proposal pending with respondent no.1 Committee.

The statement made is accepted.

Services of the petitioner shall be regularized provisionally subject to outcome of the decision on the tribe certificate validation proposal pending with respondent no.1 Committee.

With the directions as above, writ petition is disposed of. No costs.
