PER COURT :

1) Perused the order dated 5th March, 2010 passed by this Court in Writ Petition No.1779/2010 as well as order passed in Contempt Application No. 58/2011 on 22.6.2011 and we are convinced that no specific direction issued by this Court, is violated by the Respondents.

2) The petitioner contends that the list of below poverty line members shall have to be finalized by the authority and it has to be forwarded for approval to Divisional Commissioner by the concerned Block Development Officer.

Such approval is

necessary for securing benefits under Indira Aawas Yojana. However, for securing other benefits, the list has to be got approved from the Block Development Officer.

3) Learned Counsel appearing for Respondents states that revision of the list is a continuous process and time and again its approval is secured from the competent authority. It is also pointed that no specific directions issued by this court, either in writ petition or contempt petition, has been violated.

4) Keeping open option of the petitioner to avail of remedies available in law, the contempt petition stands disposed of. Notice issued earlier stands discharged.
