VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for the Petitioner : Shri Anand V Patil AGP for Respondents 1 and 2 : Shri P.S. Patil Advocate for Respondent 3 : Shri P.R. Tandale Advocate for Respondent 4 : Shri S.S. Shinde Advocate for Respondent 5 : Shri V.P. Patil ...
CORAM : RAVINDRA V. GHUGE & S.G. MEHARE, JJ.
DATE :- 29th October, 2021 Per Court :- 1.
On 20.10.2021, we had passed the following order :- "1.
We have perused and have considered the brief submissions of the learned counsel. We are informed by the learned advocate for the management that the bills for the payment of arrears of the petitioner's salary including the suspension allowance, have been submitted.
2.
We, therefore, expect respondent no.3 to consider the said bills and pass appropriate orders. If the bills are cleared, the payments of amount shall be made to the petitioner.
3.
For the said purpose, we are listing this matter in the passing orders category on 29.10.2021. We expect respondent no.3 to deal with the said bills and make a statement before us on the said date."
*2* 2.
The learned advocate representing respondent No.3/ Education Officer has placed on record the communication dated 05.10.2021 issued by the Superintendent of Pay Unit to the Headmaster pointing out certain deficiencies in the salary bills. We have taken the said communication on record, which is marked as "X-1" for identification.
3.
The learned advocate for the respondent/ Management submits that about two to three days ago, all these deficiencies have been removed pursuant to X-1 and rectified bills have been submitted.
4.
We find that the petitioner had been before this Court on two occasions. She had to file a petition earlier being aggrieved by her suspension pending disciplinary action when the Management did not initiate any disciplinary action and kept her in suspended animation. By the order of this Court dated 11.12.2019 in Writ Petition No.10527/2019, the suspension beyond 120 days was quashed and set aside. She is required to approach us once again for the pending salaries even when her subsequent suspension has been withdrawn by the Management. 5.
In view of the above, this Writ Petition is disposed
*3* off as the same stands worked out. The Education Officer shall ensure that the salary bills of the petitioner are cleared as expeditiously as possible and in any case, on or before 02.11.2021 so as to ensure that the salary is deposited in the salary bank account of the petitioner forthwith. kps (S.G.
