Learned counsel for the appellant and respondent state that mediation between the parties is successful and agreement to settlement agreement is entered into between the parties before the mediator. The said document is duly signed by the parties concerned and the counsels. In view of the settlement, appellant seeks withdrawal of the second appeal.

In view of the terms of the settlement, respondent is permitted to withdraw the amount of Rs.16,00,000/- along with the accrued interest deposited before the execution court. 3.

In view of the above, second appeal stands dismissed as 18.sa544.22.odt

withdrawn. No order as to costs.
