Respondent Nos.2, 3 and 4-Original Defendants are not contesting parties.

Respondent No.1 preferred Regular Civil Suit No.322 of 2022 for declaration and injunction. Respondent No.1 also filed an application below Exhibit-5 for temporary injunction, which came to be allowed. The Petitioner, who is Original Defendant No.1 challenged the same before the learned District Judge-1, Aurangabad by filing Miscellaneous Civil Appeal No.73 of 2023 against the order of temporary injunction granted in favour of Respondent No.1. The said miscellaneous civil appeal came to be dismissed and, therefore, the

2 of 2 903-WP.14042.2023 Petitioner had approached this Court by way of this petition under Article 227 of the Constitution of India.

This Court, by order dated 06.11.2023, directed the parties to maintain status quo.

There is no dispute that the suit had been proceeded. Learned Advocates for both the sides, on instructions from their respective parties submit that the writ petition be disposed of by continuing the said order of status quo. Considering the statements made by both the sides, writ petition is disposed of by the following order:- (i).

The order dated 06.11.2023 directing the parties to maintain Status quo to continue till the disposal of Regular Civil Suit No.322 of 2022 pending before the learned Civil Judge, Junior Division, Sillod, District Aurangabad.

(ii). Writ Petition is disposed of.
