The petition takes exception to the final voters' list published for the elections of 2015 in respect of Gram Panchayat Akole, Taluka - Gangakhed, District - Parbhani. 2.

According to learned advocate for the petitioner, the final voters' list contains names of quite a few persons twice and also contains names of quite a few dead persons so also names of persons who are not residing in the village. The petitioner, therefore, seeks striking off names of such persons from the final voters' list. Said persons are not parties to the writ petition.

Learned advocate for the State Election Commission, however, produces an order issued by State Election Commission, Maharashtra on February 10, 2015, which under clause 7 thereof refers to that it would be incumbent on the State Election Commissioner to take action pursuant to orders dated 24th April, 2007 and 11th October, 2010. He states that all these orders would be solemnly followed and that all the care would be taken to avoid voting twice and to prevent voting on behalf of dead persons or the persons who have shifted their residences.
