Heard the learned counsel for the parties.

This is an application for condonation of delay by the original claimants for enhancement of compensation. Considering that the applicants are marginal land holders and the amount of enhancement granted by the Trial Court is only Rs.2,74,000/-, the application stands allowed, subject to deposit of costs of Rs.2,000/- to be deposited to the Library of the Government Pleader, High Court of Bombay, Bench at Aurangabad, within four weeks from today.

With this, the civil application stands allowed and disposed of. Appeal be registered.

985 ca.7708.24.odt It is made clear that the applicant / appellant shall not be entitled to receive interest on the enhanced amount for the delayed period in case the appeal is allowed. The applicant to file undertaking in the appeal to that effect.
