The learned Advocate submits that the proposal seeking the approval to the continuation of the service of the petition is pending with respondent No.2. The validation proceeding in respect of tribe claim of the petitioner is also pending with the Scrutiny Committee. 2.

Learned A.G.P. accepts notice for respondent Nos.1, 2 and 4 and submits that the validation proceeding would be decided by respondent No.4 on its own merits, and depending upon the decision

73-wp-7114-20 that would be taken by respondent No.4, further decision would be taken on the proposal of the petitioner seeking approval to the continuation of the service by respondent No.2. 3.

It is for the Committee to decide the validation proceeding, which is pending since June 2017. The respondent No.2 may consider the proposal seeking approval to the continuation of the service of the petitioner (page 15) subject to the decision of the Scrutiny Committee. The same shall be decided on its own merits, preferably within a period of four months.

The Respondent No.4 - Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner, preferably within a period of nine (09) months from the date of appearance of the petitioner. The petitioner shall appear before the committee on 24.11.2020.

The writ petition is disposed of. No costs.
