Heard counsel for the Applicant - original Appellant - accused. It is stated that on the date
concerned the Applicant was admitted in the hospital and could not attend. Learned counsel for the Applicant says that he has the necessary instructions from the Applicant - accused to argue the Appeal when-ever the Court directs.

Heard the A.P.P. also. Perused the record.

Looking to the reasons given and Exhibit A-2 attached, lenient view is taken. However, it is made clear to the Appellant - accused through his counsel that when the matter comes up for hearing if the same is not argued, next time no leniency would be shown.

The show-cause notice issued be treated as withdrawn. The bailable warrant issued if not yet executed, is withdrawn. Hamdast of withdrawal of bailable warrant be handed over to the Appellant through the counsel to submit the same
to the Court/ police station concerned.
5.
List the Criminal Appeal No.194 of 2003 for hearing finally on 22nd August 2016.
6.
The Criminal Application stands disposed of, accordingly.
