Mr. B.V. Thombre, Advocate for the Petitioner Mr. A.V. Lavte, AGP for State Mr. A.G. Talhar, Advocate for respondent No. 2 Mr. S.V. Kuptekar, Advocate for respondent No. 5 and 8 .......
CORAM : NITIN B. SURYAWANSHI AND SANDIPKUMAR C. MORE, JJ.
DATE :
26th AUGUST, 2025 ORDER :
1.
By order dated 21.04.2025 this Court directed the respondents No. 5 and 8 i.e. Medical Officer and District Health Officer to decide the petitioner's claim for grant of family pension on its own merits, within a period of five weeks from the date of receipt of the order.
2.
By filing affidavit in reply it is contended that proposal of the petitioner is rejected and said fact is communicated to the petitioner by communication dated 07.07.2025.
Bhagyawant Punde This order is corrected pursuant to the speaking to the minutes order dated 04.09.2025.
{2} 949-CP-456-2025 II 3.
Learned advocate for the petitioner contends that respondents have misinterpreted the order passed by this Court and respondents are not empowered to consider the pension proposal of the petitioner. It is only the Accountant General who can take decision on the pension proposal of the petitioner. 4.
We cannot entertain this contention in contempt jurisdiction. Since by communication dated 07.07.2025 respondents have decided the pension proposal of the petitioner, order is complied with, hence contempt petition is disposed of. If the petitioner is aggrieved by said decision he may avail appropriate remedy.
