***  Mr.Ravibhushan P. Adgaonkar, for Petitioner.  Mr. S. D. Ghayal, Addl. GP for Respondent Nos.1 and 2.  Mr. Ajit B. Kadethankar, for Respondent No.3.  Mr. S. P. Urgunde, for Respondent No.5.

*** CORAM : MANISH PITALE AND Y. G. KHOBRAGADE, JJ.

DATE : 15th JULY 2025.

ORAL ORDER (PER - MANISH PITALE, J.) :

1.

Having heard Mr. Adgaonkar, learned counsel appearing for the petitioners and Mr. Kadethankar, learned counsel appearing for respondent No.3 - State Election Commission, we are of the opinion that the present petition is premature.

2.

This is for the reason that in terms of the order dated 10th June 2025, issued by the respondent - State Government exercising power under Section 5(3) of the Maharashtra Municipal Corporations Act, 1949, the process of ward formation from clause 6 onwards of the said order is yet to be undertaken.

Shrikant Malani

954.WP.8074.2025.doc 3.

The said order provides for elaborate procedure of issuing notices, giving sufficient publicity to the proposed ward formation, inviting objections, considering the same and thereafter, as per clause 10 issuing the final ward formation.

4.

The petitioners would have sufficient opportunity to raise the issues sought to be raised in this petition, once the process under the said order is triggered in accordance with law. 5.

Hence, the petition is dismissed as premature. (Y. G. KHOBRAGADE, J.) (MANISH PITALE, J.) Signed by: Shrikant Malani Designation: PA to Hon'ble Judge Date: 16/07/2025 10:55:10 Shrikant Malani
