Having considered the disputed issues raised in this petition and the clauses of the agreement between the petitioner and the concerned respondents, especially, clause 37 by which, he can approach the Principal Secretary, School Education and Sports Department, State of Maharashtra, Mumbai and by virtue of clause 41, he can approach the Civil Court at Pune, the learned advocate for the petitioner submits that the petitioner would avail of the remedy as is provided under clause 37 of the agreement. 2.

In view of the above, this Writ Petition is disposed

In the event, the petitioner approaches the Principal Secretary in accordance with clause 37 of the contract, we expect the concerned authority to deal with the grievance of the petitioner as expeditiously as possible and preferably on or before 28.02.2023. If the grievance of the petitioner is not redressed, the petitioner would be at liberty to approach the Civil Court at Pune in accordance with clause 41 of the contract. All contentions are kept open.
