After hearing the learned counsel for the parties, it appears that an alternate efficacious remedy in the form of appeal is available to the petitioner. Learned counsel for the respondents concede to said position.

In view of aforesaid, writ petition is not being entertained and disposed of with liberty to the petitioner to prosecute alternate remedy.

It is expected that the petitioner would proceed with lodging of proceeding within a fortnight from today. Time consumed during the pendency of this writ petition and lodging of proceedings within a fortnight from today would be given appropriate treatment in case of condonation of delay. Hopefully, the alternate remedy would be expeditiously proceeded with.
