Learned AGP submits the affidavit-in-reply on behalf of respondent No.1 and places on record an order passed by Dean, Government Medical College, Chhatrapati Sambhajinagar, dated 13th August 2024 and submits that by this order there is compliance of the order passed by this Court on 10th October 2023 in Writ Petition No.11801 of 2023. He also submits that since there was only one peon i.e. petitioner who was appointed on daily wages, therefore, the seniority-list as directed by this Court has not been prepared. The other peons who were in

cp-593.24 employment were the regular peons and they have retired by superannuation.

While considering the order dated 13th August 2024, it appears that the regularization has been directed, however, as regards the salary is concerned, we find that it lacks some what clarity. But a statement is now made by Mr. Dinesh Waghmare, Principal Secretary, Medical Education and Drugs Department, stating that since the regularization is from the date of appointment i.e. from 5th October 1996, the petitioner would be entitled to regular pay plus increments and also the changes in the pay in view of different pay commissions. The said statement is therefore, now taken as undertaking and we hope that the arrears would be accordingly disbursed.

We take that the order is complied with and therefore, dispose of the Contempt Petition.
