PER COURT :- The petitioner sought permission to correct the typographical mistake occurred in the affidavit of evidence presented by the petitioner. The application has been turned down by the trial Court, holding that the affidavit presented to the Court is not a pleading. Technically speaking the view taken is in consonance with the legal provisions. In the facts of the case, it would be open for the petitioner to tender an additional affidavit, pointing out the mistake.
