Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.163 of 2024 registered with Khultabad Police Station, District Aurangabad for the offence punishable under Sections 307, 324, 323, 504, 506 r/w 34 of the Indian Penal Code.

In first FIR, there was no specific allegation against the applicant that he caused the injury to the injured Kishor or his wife by iron rod. However, in statements of the witnesses, it has been alleged against the applicant that he assaulted Kishor with iron rod. The medical certificate does not disclose the injury to his hand or legs as alleged in these statements. The prosecution has no evidence to show that any of the injured sustained the injury by iron rod. Besides this, the iron rod has been recovered from the applicant. Nothing
953-ba-1098-2024.odt (2) remained to be recovered from him. He has roots in Khultabad. Therefore, there are no chances of his absconding. The material investigation has been completed. Hence, he deserves bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant, Raju Manikarao Jadhav, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses and shall attend the trial on each and every date.
(b) The applicant shall not threaten the witnesses or the injured.
