Heard learned counsel for the applicant and the learned APP for the State.

The Court has discussed the facts of the case while passing the order dated 14.07.2022. After having gone through the allegations and checkered history of the relation between the victim and the applicant, this Court has expressed the view that the complainant was intending to marry the applicant, but her father was not agreeable. It is also observed by this Court that she was well aware that the applicant was married. The victim was maintaining the relation with the applicant since 2012. The possibility of pressuring by her parents to take the action against the applicant cannot be ruled out.

Learned APP opposed the application contending that the applicant was demanding money to the victim. In reply, learned

937-aba-915-2022.odt (2) counsel for the applicant would submit that the record reveals that there were money transactions between the applicant and the victim. They were giving and taking the money to each another. 4.

In view of the facts of the case and the age of the victim, this Court is of the view that the prosecution has no case for custodial interrogation of the applicant. Hence, the following order :

ORDER

I) The application is allowed.

II) Interim protection granted to the applicant by order dated 14.07.2022 is confirmed on the same terms of bail bonds. (S.G. MEHARE, J.) Mujaheed//
