Heard learned counsel for the applicant, the learned A.P.P. for the respondents/State.

The applicant is seeking bail in FIR No. 190/2023 registered with Pishor Police Station, District Aurangabad for the offences punishable under Sections 353, 143, 323, 341, 504, 506 of the Indian Penal Code.

Perused the papers. It seems to be a quarrel between the two communities and out of that quarrel the present crime is registered. There are many persons involved in the crime. Considering the nature of the offence, the Court is of the view that further detention of the applicant would serve no purpose. However,

945-BA-1035-23.odt since the question of law and order may arise, certain conditions may be imposed. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant Tohij Salim Patel be released on bail on furnishing P. B. and S.B. of Rs. 50,000/- with one solvent surety of the like amount, in aforementioned crime registered with aforementioned police station, on the following conditions :- (a) He shall not tamper with the prosecution witnesses. (b) He shall stay away from his village Shelgaon, Taluka Kannad for two months from the date of his release on bail. (c) He shall attend the concerned police station as and when called by the Investigating Officer on written notice, till filing charge sheet.
