The petitioner seeks to challenge the Order passed by the Deputy Commissioner Supplies, Nashik dated 17.7.2015 by which Revision Application No. 18/2015 filed by the petitioner has been rejected and his prayer for restoration of the fair price shop license has been rejected.

It is submitted that the petitioner has been acquitted in a criminal case in 2018 and therefore, he has filed this petition.

At this juncture, the learned Advocate for the

2 917 wp8581-19 petitioner seeks liberty, on instructions, to withdraw the petition.

The learned A.G.P. submits that considering the Judgment delivered by this Court in Gautam Kathalu Hiwale V/s the State of Maharashtra & Ors., (Writ Petition No. 2640 of 2019) dated 4.7.2019, the petitioner can now approach the State Government under Order 24(2) of the Maharashtra Scheduled Commodities (regulation of distribution) Order 1975 as such a revision has to be filed within 30 days from the date of the receipt of the impugned Order. He does not have an objection for a simplicitor withdrawal.

The learned Advocate for the petitioner is agreeable.

In view of the above, this petition is disposed off as withdrawn, simplicitor.
