1) Heard. Issue notice to respondent. Shri Kutti, learned APP waives service for State.
2) Learned Counsel appearing for the applicant submitted that after having suffered the conviction for the offences punishable under the provisions of Prevention of Corruption Act, the applicant has been dismissed from Government Service and thereafter has settled at Aurangabad. The learned Counsel further submitted that in the order passed by this Court on 12th June, 2017, the applicant has been directed to attend Police
Station at Manwat pending disposal of the present appeal. The learned Counsel submitted that in view of the fact that now the applicant has settled at Aurangabad, he finds difficult to attend Police Station, Manwat. The learned Counsel submitted that the applicant undertakes to attend police station which ever may be prescribed within the jurisdiction of Aurangabad and has, therefore, prayed for necessary modification in the earlier order.
3) The learned APP has submitted for passing appropriate orders.
4) The request so made by the applicant deserves to be considered. Hence, the following order, -
ORDER
i) The condition, as has been imposed by this Court in order dated 12th June, 2017 that pending disposal of the appeal, the applicant shall attend police station, Manwat, Tq. Manwat,
District Parbhani, is modified and it is directed that pending disposal of the appeal, the applicant shall, once in a month, attend office of Anti-corruption Bureau, Aurangabad.
ii) In view of the modification in the aforesaid condition, the further modification requires to be ordered in clause (5) of the earlier order and hence it is directed that the Officer of the Anti-corruption Bureau, Aurangabad shall submit report as about the attendance of the applicant in the said office as directed by this Court once in every six months.
Iii) The Criminal Application stands disposed of.
