This is an application for bringing legal heirs / legal representatives of deceased appellant No. 3 Shankar Bhaurao Khavane, who has admittedly died on 19.10.2021 as per the copy of death certifcate annexed herewith. Right to sue still survives on his behalf. The delay for fling the application is only of 44 days.

As such, for the reasons stated in the application the aforesaid delay stands condoned and the application stands allowed. No order as to costs.
