Learned APP submits that 'A' Summary has been filed before the trial Court. Learned Advocate for the petitioner submits that he is not aware about the same.

In this scenario, the petitioner would receive notice from the learned Magistrate in respect of 'A' Summary or the petitioner may appear before the Magistrate suo moto and may take up the further legal proceedings.

We need not keep the Petition pending, which is for handing over of investigation from respondent No.6 to respondent No.5. Thus, we dispose of the Writ Petition with liberty to the petitioner to approach this Court as and when occasion arises in future.
