The learned counsel for the petitioner submits that by the impugned order, the court has refused to appoint a Court Commissioner, as it would amount to the collection of evidence on behalf of the petitioner.

He submits that he will move an appropriate application for the appointment of the Court Commissioner after both parties have led their evidence, if necessary.

3.

The petition is dismissed with liberty to file such an application as noted above, and if such an application is filed, the court will decide it in accordance with the law.
