By the impugned order the trial court has rejected the application for amendment.

The learned counsel for the respondent submits that the suit is at the stage of argument and that the present amendment is only for the purpose of delaying the suit.

Per contra, learned counsel for the petitioner submits that the matter is fixed on 14.08.2024 and if the amendment is permitted he would conduct the argument on 14.08.2024 or within 10 days thereafter.

In view of the above submissions, the amendment as prayed in the amendment application is allowed with consent of the respondent. However, it is clarified that no further adjournment would be granted to the petitioner / plaintiff beyond 10 days and that the petitioner / plaintiff to work out the matter as expeditiously as possible, on 14.08.2024 or in any event within 10 days thereafter.

The petitioner to pay the costs of Rs.5,000/- to the "Advocate Bar Association, Tuljapur" within four (04) weeks from today. 7.

With the above observations, the writ petition is accordingly allowed and disposed of.
