We have heard the learned counsel for petitioner. The proposal for opening new college is rejected by the Government. The impugned order suggests that the University had also given negative recommendation. The State Government only in exceptional circumstances and for reasons to be recorded, can grant letter of intent in spite of negative recommendation. In the present case, the Government, it appears, has accepted the negative recommendation of the University. The last date for granting final permission is also over.

997 wp.8302.21.odt In view of that, we need not go into other aspects of the matter. The writ petition is disposed of. No costs.

In case, fresh advertisement is issued, the petitioner may apply afresh. In that event, naturally the said proposal would be considered on its own merits.
