Mr. Yawalkar, learned A.G.P. submits that the aspect of seniority has been decided by the Education Officer on 14.05.2019, and it is held that present respondent no. 5 is senior and he is allowed to function as In-charge Headmaster.

Mr. Brahme, learned counsel for the petitioner submits that the said arrangement is temporary. The petitioner has forwarded the

2 wp 7627.18 proposal seeking approval to the appointment of Mr. Misal as permanent regular Headmaster. The said proposal is not decided.

Mr. Yawalkar, the learned A.G.P. submits that in case the said proposal is pending, the Education Officer would decide it on its own merits.

In the view of above, if the proposal is forwarded by the petitioner of Mr. Misal, seeking approval to his appointment as permanent Headmaster and the same is pending with the Education Officer, then the Education Officer shall take decision upon it on its own merits, in accordance with law, after hearing the concerned persons, expeditiously and preferably within a period of four (04) months from today.

The writ petition is disposed of. No costs.
