The petitioner contends that respondent no.5 has encroached over his property bearing C.T.S. No.394.

As far as C.T.S. No.393 is concerned, the Chief Executive Officer has observed in his letter dated 31.12.2016 (Page 25) that Mr. Jiyauddin and Mr. Sadik Ali are in illegal occupation and that further proceeding under Section 51, 52 and 54 are being undertaken. The proceedings are already undertaken. The petitioner is claiming his right in C.T.S. No.394.

It is for the authority to take further action that is Chief Executive Officer of the Wakf Board. The petitioner may move before the Chief Executive Officer.

Writ Petition is disposed of. No costs.
