Heard learned Counsel for respective parties. Respondent No.2 - Insurance Company is stated to have deposited an amount of Rs.10,31,527/- in this Court. The applicant shall be permitted to withdraw 50% of the amount out of the amount deposited by the Insurance Company in this Court on furnishing an undertaking to this Court that in the event of success of appeal, he shall redeposit the amount in this Court within a period of twelve weeks from such decision. The balance amount shall be invested in Fixed Deposit in any Nationalised Bank initially for a period of three years and the FDR shall be renewed thereafter, if required, for the period till disposal of appeal.

Civil Application stands disposed of.
