Heard, Mr. Phule, learned AGP appearing for the applicants. None present for the respondent, though served.

This is an application for condonation of delay of 1549 days caused in filing the first appeal. Inspite of sufficient opportunity, no say/reply is fined in the matter.

I have gone through the reasons/ grounds stated in the application. From the same, it appears that the reference court has passed the award on 20th January, 2009 and the concerned AGP has intimated the same to the office of the applicant and thereafter the applicant approached to the learned AGP office. The AGP has obtained legal opinion from the Joint 1/2
63delay.odt Secretary, Law and Judiciary Department, Aurangabad who recommended to present the appeal. Thereafter, the applicant sent proposal to the concerned AGP and after going through the necessary documents, the appeal was presented in this Court and in that process the delay is caused.

In view of the above, for the reasons stated in the application, the delay in filing the first appeals is hereby condoned. The Civil Application is disposed of.
