Present application has been filed for withdrawal of amount. Amount of Rs.9,87,945/- has been deposited by respondent No.1. It has been stated that the appeal has been mainly filed on the ground of quantum. The disability has not been properly assessed and the effect of the disability on the income has also not been properly assessed. Taking into consideration the points raised, case is made out for partial withdrawal of the amount.

Applicant is allowed to withdraw amount of Rs.4,00,000/- subject to giving an undertaking within a period of eight weeks that he would make the said amount good, if directed at the time of final disposal of the appeal.
