There are counter crimes: The wife has filed one against the husband and his relatives for the offences punishable under section 498A, 323, 211, 504, 506 r/w. 34 of the Indian Penal Code being FIR no. 222 of 2022 of Cantonment (Chavani) Police Station, Aurangabad. Husband of Puja has filed criminal case being FIR no. 213 of 2022 against her relations from the paternal side for the offences punishable under section 325, 323, 504, 506 r/w. 34 of the Indian Penal Code registered with the same Police Station.

It appears that both the sides have amicably settled the dispute. They have also produced terms of compromise duly verified before the Section Officer of this Court.

The husband and wife having resumed cohabitation, we see no reason to once again ignite the dispute when the parties have decided to reach an amicable settlement. The proposed compromise is not against public policy. The offence involved also cannot be termed as heinous.

We allow the applications and quash and set aside the FIR no. 222 of 2022 of Cantonment (Chavani) Police Station, Aurangabad for the offences punishable under section 498A, 323, 211, 504, 506 r/w. 34 of the Indian Penal Code and FIR no. 213 of 2022 of Cantonment (Chavani) Police Station, Aurangabad for the offences punishable under section 325, 323, 504, 506 r/w. 34 of the Indian Penal Code.
