Heard the learned counsel for the applicant and learned APP for the respondent/State.

The applicant, who is the first informant filed this application for cancellation of bail granted to respondent No.2 on 18.08.2017.

The oral arguments advanced by the learned counsel for the applicant does not find place in the application. 4.
The sole ground that is pleaded in the application that the respondent while seeking the bail had made two statements that firstly, he was a student of B.Com First Year
962-ACB.102-24.odt and also doing the travelling business. There are many students in the society who learn and earn. It is very difficult to accept the contention of the applicant that making such statement mislead the Court while securing the bail. This is nothing but a chance application.

Learned APP has correctly pointed out that there is no material as such pleaded in the application.

Since this appears to be a pressurize tactics on the respondent/accused whose trial is pending before the learned Sessions Court. The application is unfounded, baseless, concocted and false. Since the applicant has wasted the valuable time of the Court, the application stands dismissed with costs of Rs.10,000/- to be paid to the respondent/accused by depositing the same with the Trial Court.
