Heard the learned Counsel appearing for the respective parties. Perused the impugned Judgment and Award and the grounds of objections raised in exception to the said Judgment and Award. In view of the submission made, the following order is passed.

ORDER

(i) The applicants are permitted to withdraw 50% of the deposited amount with interest accrued thereon, on submitting an undertaking to the satisfaction of the Registrar of this Court. (ii) The balance 50% amount along with the interest

2 2392.2019.CA.doc accrued thereon be invested in Fixed Deposit Receipt in any Nationalized Bank for the period till disposal of the appeal. (iii) The amount as has been permitted to be withdrawn, be transmitted to the Motor Accident Claims Tribunal at Ahmednagar so as to facilitate its withdrawal by the applicants - claimants.

(iv) The undertaking be submitted before the Motor Accident Claims Tribunal at Ahmednagar and the learned Tribunal in turn shall forward the said undertaking to this Court. (v) Civil Application for withdrawal of amount stands disposed of.
