The present application is filed in the nature of review with regard to certain observations made in para 1 of the order. It was for the first time, the permission was granted by the AICTE with intake capacity of 120 students i.e. 60 in Automobile Engineering and 60 students in Diploma in Mechanical Engineering and it was not a case of increase in intake capacity.

The learned counsel for the Respondent do not dispute this position.

In light of the above, para 1 of the order dated 2.7.2015

stands deleted and in its place following para stands substituted : "We have heard learned counsel for respective parties. The petitioner institute has been granted approval to start automobile Engineering and Diploma in Mechanical Engineering faculties with intake capacity to 60 students each i.e. total 120 students. The State Government, however, has not included the petitioner institution in the notification for admission published in the year 2014-15. This Court vide interim order dated 21.7.2014 has allowed the petitioner to admit the students as per the intake capacity permitted by the AICTE. Even in the case of Orissa Technical Colleges Association Vs. AICTE and another (Special Leave to Appeal (Civil) No.7277 of 2014, dated 9.5.2014), the Apex Court vide interim order has allowed the AICTE to grant approval for the year 2014-15 and 2015-16."
