The learned A.P.P. today submitted on the basis of the report given to him by the Investigating Officer that B Summary Report is already filed in the Court and it is pending in the Court. Two copies of the report are to be filed in the Court. As B Summary Report is filed and it is up to the Magistrate either to accept it or reject it, no direction as claimed of transfer of investigation can be given at this stage. It is open to the petitioner to come to this Court again, if the report is rejected. 2.

The present proceeding is disposed of in view of the aforesaid circumstance.
